Digital Millenium Copyright Act

In accordance with the Digital Millenium Copyright Act (http://www.copyright.gov/), HIS has designated an agent to receive notification of alleged copyright infringement occuring on websites hosted on HIS servers. Our response to notices of alleged infringement that comply with the DMCA [Title 17, United States Code, Section 512(c)(3)(A)] may include removal of or blocked access to the material named in the infringement notification.

If we remove or block access to comply with the DMCA, we will make a good-faith effort to notify the contact person of the affected site so that they may make a counter notification [Title 17, United States Code, Sections 512(g)(2) and (3)].

Infringement Notification

To file a notice of infringement with HIS, you must provide written communication to our designated agent:

Please note: If you materially misrepresent that online material, a product or activity is infringing your copyrights, you will be liable for damages (including court costs and attorneys' fees) and could be subject to criminal prosecution for perjury.

Your written Notification of Claimed Infringement must contain the following items to comply with Title 17, United States Code, Section 512(c)(3)(A):

  1. Identification of the copyrighted work claimed to have been infringed or a representative list if multiple works are involved.
  2. Description of the material that is claimed to be infringing and provide sufficient information to permit HIS to locate that material (e.g. the URL).
  3. Your contact information, including postal mailing address, telephone number and email address.
  4. Statement that you have "a good faith belief that use of the material described above on the alledgedly infringing web pages is not authorized by the copyright owner, its agent, or the law."
  5. Statement that the information provided in the notice is accurate and that, under penalty of perjury, you are authorized to enforce the copyrights that you allege have been infringed.
  6. Physical or electronic signature of the copyright owner or an agent authorized to act on behalf of the copyright owner.

To ensure prompt response, include all of the above information (preferably in a numbered list as above).

Counter Notification

The owner or administrator of an affected site may make a counter notification. When we receive a counter notification, we will promptly provide a copy of the counter notification to the person who provided the notification under subsection (c)(1)(C) and inform them that we will restore or cease blocking access to the material in 10 business days. Unless our designated agent first receives notice from the complainant that such person has filed an action seeking a court order to restrain the HIS subscriber from enagaging in infringing activity relating to the material that was removed or blocked, HIS will restore or cease blocking access to the material on the HIS subscriber's site.

To file a counter notification with HIS, you must provide written communication to our designated agent:

Your written Counter Notification must contain the following items to comply with Title 17, United States Code, Section 512(g)(2) and (3):

  1. Identification of the specific URLs that HIS has removed or blocked access.
  2. Your contact information - including name, postal mailing address, telephone number and email address - and a statement that you consent to the jurisdiction of the Federal District Court in which your address is located (or Montgomery County, Maryland if your address is outside the United States), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
  3. Statement that you "under penalty of perjury" have "a good faith belief that all of the material identified above was remove or blocked as a result of a mistake or misidentification of the material to be removed or blocked."
  4. Your physical or electronic signature.
